Welcome to SomniART. By downloading, installing, or using the SomniART application ("App"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using SomniART, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

SomniART is an AI-powered image generation application that allows users to create artwork by entering text descriptions. The App uses third-party AI models to generate images based on user prompts.

3. Credits and In-App Purchases

SomniART uses a credit-based system. Each image generation requires credits.
New users receive a limited number of free credits upon first use.
Additional credits can be purchased through in-app purchases via the Apple App Store.
Credits are consumable and non-transferable. Once used, credits cannot be recovered.
All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.
Credit balances do not expire.

4. User Content and Conduct

You are solely responsible for the text prompts you enter into SomniART. You agree not to use the App to:

Generate content that is illegal, harmful, threatening, abusive, or otherwise objectionable
Create content that infringes on intellectual property rights of others
Generate content depicting real individuals without their consent
Produce content that exploits or harms minors in any way
Create content for fraudulent, deceptive, or misleading purposes

We reserve the right to restrict or terminate access to users who violate these guidelines.

5. Intellectual Property

Generated Images: Images generated through SomniART are created using AI models. You may use the generated images for personal and commercial purposes, subject to the terms of the underlying AI model provider (Replicate/FLUX). You are responsible for ensuring your use complies with applicable laws.

App Content: The SomniART app, including its design, code, branding, and original content, is owned by Burhan Bisgin and is protected by intellectual property laws.

6. AI-Generated Content Disclaimer

SomniART uses AI technology to generate images. Please be aware that:

AI-generated results may vary and are not guaranteed to match your expectations
The AI may occasionally produce unexpected or imperfect results
We do not guarantee that generated images will be free from artifacts or errors
Generation results depend on the AI model and may change as technology evolves

7. Service Availability

We strive to keep SomniART available at all times, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

Maintenance or updates
Third-party service outages (AI model provider, payment processor)
Technical issues beyond our control

If a generation fails due to a service error, the credits used for that generation will be refunded to your account.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SomniART and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the App.

9. Disclaimer of Warranties

SomniART is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
